iPod Touch Jailbreak? Empty iPod Touch Jailbreak?

Ok , i'm just asking before i do this.

Is it illegal to Jailbreak your iPod touch? And will it damage it?

Cos I Know it voids the warrenty , but mine is expired

Meh , it's fine. I'm not going to do it anymore. It screwed up my iPod and wyped all the songs!
